Consequences for Teen Driving Violations in Illinois
Illinois uses a Graduated Driver's License system for teens that is divided into three phases:
- Permit phase for drivers who are 15 years old;
- Initial licensing phase for drivers aged 16-17; and
- Full licensing phase for drivers aged 18-20.
During each phase, teens are required to maintain a clean driving record before they can graduate to the next phase. A moving violation for an offense such as speeding during the permit phase results in a nine month waiting period before a teen can apply for a driver's license. During the initial and full licensing phases, a moving violation will extend their time within that phase. Two or more moving violations during these phases will result in a driver's license suspension. The minimum length of a suspension is one month, although longer periods of suspension may apply depending on the seriousness of the offense and whether a driver had any previous violations.
Illinois has a zero tolerance law for underage DUI. This means that teens caught driving with any measurable trace of alcohol in their system will face a driver's license suspension. Teens caught with a blood alcohol content (BAC) level of .08 percent or higher (the legal limit for adults) are subject to harsher penalties under the state DUI/DWI laws. Other serious offenses that could lead to harsher penalties for teens include reckless driving, texting and/or cell phone use while driving, and leaving the scene of an accident.
