All it takes is for both parties to agree that there are "irreconcilable differences" and that the marriage cannot be salvaged. Alternatively, if one spouse objects to a divorce while the other wants to move forward with it, a period of six months' separation will be considered irreconcilable differences and grounds for divorce.

Whether or not a marriage broke down due to misconduct from one spouse, the court will split up assets equitably. For shorter marriages, this may be an approximate 50/50 division of assets (such as pensions, life insurance, and investments). In longer marriages or situations where one spouse earned significantly more than the other, the division may favor the spouse with less earning potential.

What to Expect with Spousal Maintenance

Most people are familiar with alimony, which is referred to in Illinois as spousal maintenance. If necessary, one spouse may be required to support the other by making ongoing payments after the dissolution of the marriage. In Illinois, there is a general formula that may determine how much a spouse will pay in maintenance:

  • (Paying spouse's net annual income times .33) – (Receiving spouse's net annual income times .25) = total annual maintenance

The duration of the alimony payments depends on the length of the marriage prior to the divorce. For marriages that lasted five years or less, the maintenance period will last for 20% of that time. The percentages increase for longer marriages. At the 20-year mark, the court may order a maintenance period as long as the marriage itself, or support may be paid indefinitely.
