Prenuptial Agreements in Illinois

“A prenuptial agreement is a common way for a couple to codify their intent prior to marriage regarding a variety of rights and obligations that could arise under the enjoyment or termination of their marriage.” In Illinois, the Illinois Premarital Agreement Act governs a prenuptial agreement. There are many formalities that have to happen in order to file for a prenup. First of all, a prenuptial agreement according to the Illinois Uniform Premarital Agreement Act has to be in writing. There does not have to be an exchange of assets or losses for the agreement to be enforceable. Once the marriage has occurred, the agreement begins. It can only be modified or evoked if both couples give consent in writing.

In Illinois, an agreement can cover just about anything that is not criminal, doesn’t affect public policy, or is not harmful to their children’s right to support. It can include any rights and obligations regarding any or all property that is held by the spouse at any time. The division of this property can come from divorce, separation, death or any other event.

Should I Get Back Surgery After My Car Accident?

After a car accident, many victims begin to experience severe chronic pain in the weeks and months after their initial injuries have occurred. Sometimes there are triggers for this pain, but other times it can just be an adjustment to a new way of life with constant injuries. Medication and physical therapy might be able to help reduce the pain or provide techniques for reducing the overall symptoms, but some patients consider surgery if the pain is simply too great following a car accident. There are several different types of back surgery. A laminectomy, for example, takes bone out from on top of the spinal canal and is used for cases of spinal stenosis. A diskectomy, on the other hand, takes out part of a herniated disc to cut down on inflammation. Artificial disk surgery can also be used to treat cases where back pain is coming from an area where two discs are colliding or where discs have been injured from an accident. Choose your specialist carefully to determine whether this is the best option for you. Surgery can be a viable option for some patients, but not all. The Mayo Clinic offers guidelines about scenarios when a patient should be evaluated for back surgery. When you think about grieving, you may think of the loss of a loved one. Isn’t that essentially what divorce is? You have lost the person that you thought that you would spend the rest of your life with. For this you have to allow yourself to go through the grieving process completely. You will go through a variety of emotions including sadness, anger and depression. Not only are you grieving the loss of your spouse, but you are also grieving the relationship itself.

Spend some time with friends and family who are there to support you. Many times, in the case of divorce, people tend to withdraw from the outside world, assuming that there is no one out there that understands what they are going through. During and after a divorce, you can seek out a support group for recently divorced people.

What Should you do if You're Involved in a Car Accident?

Car accidents are not nicely planned out; they happen when you least expect them. Because of this, it is important to know what to do in the event that you are involved in one. The Illinois DMV has published an article explaining what to do when you are in a car accident. First of all, after being involved in an auto accident you should stop, and if possible, park your car in a safe place. After you have cleared the road, you should then check and see if anybody is injured or needs assistance. If anybody is injured badly, cover them with a blanket or coat to help prevent shock, while making sure not to move them. Call 911. After taking care of anybody that needs medical attention, exchange information with all parties involved in the accident.Make sure you have the following information:
  • names,
  • addresses,
  • insurance information,
  • driver's license numbers,
  • license plate numbers, and

Spousal Support

LucyWhen you are going through a divorce, one of the steps is to determine spousal support. Alimony, or spousal support, can be awarded to either spouse. How much will be owed and for how long the spousal support will be paid must be determined.

The court must decide all of this without consideration of any marital misconduct which may have taken place. Factors that are considered by the court to decide upon spousal support include:

  • The duration of the marriage
  • The standard of living during the marriage
  • The needs of each spouse
  • The current and future earning capabilities of each spouse
  • Any impairment that may affect the earning abilities of the spouse that is seeking maintenance
  • Any lack of education, training, career opportunities or employment that the spouse seeking support may have due to that spouse having spent his or her time on domestic duties during the time of the marriage
