It is getting tougher and tougher each day. How much more can either party take? Whether it be fighting, ignoring or just being indifferent, the marriage has dissolved itself and now is the time to do it legally. Getting a divorce isn’t in anyone’s ideal plan, but in some cases, it has to happen. However, a divorce isn’t as easy as 1-2-3.

Lawyers and courts are very detailed oriented. You will be asked many questions over and over but in different ways. You will feel like it will never end; however, there are things you can confidently go in knowing and being prepared with in such meetings.

Prior to officially filing for divorce, your lawyer will need information to make sure all paperwork can be done properly. Simple information such as both spouses’ names, birth dates and social security numbers are an obvious; but, then there is information on children. Names, birth dates and other information about children you have together and from previous relationships will be needed. In order to make sure the courts have all of the required information to make a wise decision it is important to gather that up.

Is Divorce the Right Choice for You?

Posted on February 16, 2013 in Family Law

divorce on paper imagePeople grow apart. Communication is lack luster. It seems useless to try.

All excuses are used for a marriage to be dissolved and for both parties to move on and forward. But is it really in the best interest? Can both parties do SOMETHING to save the marriage?

Yes. But sometimes, it is best to go separate ways. According to Power of Two Marriage Program there are ways to save a marriage and there are clear reasons for a divorce.

When one spouse clearly has the desire to control the other through verbal threats, anger or constant criticism, grounds are there. Who wants to be told how to behave? Who wants to be told who they should hang out with, whether it is with friends or family? Finances in general are hard for couples to navigate through, but being out of the loop on finances or not having access to the family fund is controlling.

Addiction, whether it's to gambling, drugs, alcohol or something else, is a disease that needs serious professional help and support. When it harms the one's spouse, children and the family in general, it can lead to such damaging effects that divorce may be the best way to approach the relationship anymore. The spouse can try as hard he/she wants, but if the addict does not want help, they make it clear that their priorities are not the spouse, children and family, there may not me another option. Sometimes it is mental disorder that if left unchecked, can lead to repeated cheating or physical abuse or mistreatment of the children through verbal, physical, emotional or sexual abuse.

Tax Questions about Divorce

Posted on February 10, 2013 in Family Law

Tax Time CalculatorAs the filing deadline for taxes is rapidly approaching, those who are divorced or are considering divorce should review the typical concerns that crop up during this time for people as they prepare their taxes.

Your filing status is determined by your marital status as of December 31st of the tax year. You have to file jointly even if you are living separately and going through the divorce process. It is beneficial to file jointly as certain deductions and limits are doubled for married couples. There is also bad news; both partners would be liable in the event of an audit.

Another area that could result in a tax break is having a dependent. In the majority of cases, the custodial parent can claim a child as a dependent by having the child for more than half of the year. Certain divorce decrees give the non-custodial parent the corresponding tax break for claiming a dependent child in the course of splitting property, so it is important to review your divorce agreement.

Splitting Chores Equally May Result in Divorce

Posted on February 04, 2013 in Family Law

chore sharingAccording to a Norwegian study published last year, couples who split housework equally between husband and wife had almost a 50 per cent higher rate of divorce, compared to marriages where women did most of the chores.

However, this isn’t a valid reason for a husband to skimp on helping out. The researchers couldn’t find any specific cause-and-effect correlation; instead, they believe the statistic comes from couples having “modern” attitudes.

"In these modern couples, women also have a high level of education and a well-paid job, which makes them less dependent on their spouse financially. They can manage much easier if they divorce," Thomas Hansen, one of the co-researchers, says. He also claims that many modern couples don’t view marriage as sacred as it used to be, which may be another factor in the high divorce rate.

Hansen offers another possible reason why couples who share housework have a higher divorce rate: sharing chores can have couple bickering about the best way to do something. If chores are separated, spouses can’t bicker with each other that their way is more effective.
